Terms & Conditions Agreement
This document outlines the contractual obligations and service agreements that govern property listings, transactions, and interactions on the City Real Estate Portal platform.
General Conditions
These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("User", "You") and City Real Estate Portal ("Company", "We", "Us") governing your use of our real estate platform and related services.
- This Agreement is effective upon your registration or first use of the Platform.
- You must be at least 18 years of age to enter into this Agreement.
- By using the Platform, you represent that you have the legal capacity to enter into contracts.
- This Agreement supersedes any prior agreements or communications between the parties.
Service Agreement
City Real Estate Portal agrees to provide the following services subject to the conditions outlined in this Agreement:
Listing Services
Online property listing, display, and management tools for builders, agents, and owners.
Discovery Services
Property search, filtering, and comparison tools for buyers, renters, and investors.
Communication Services
Enquiry forms and messaging to connect property seekers with listing owners.
Premium Services
Subscription plans offering featured listings, priority placement, and advanced tools.
Service availability may vary based on your subscription plan. We reserve the right to modify, suspend, or discontinue any service with reasonable notice.
Listing Conditions
All property listings published on the Platform must comply with the following conditions:
Accuracy & Authenticity
All property details including price, location, area, amenities, and images must be accurate and represent the actual property. Misleading or false listings are strictly prohibited.
Legal Ownership / Authorization
You must either own the property or have written authorization from the property owner to list it on the Platform. Unauthorized listings will be removed immediately.
No Duplicate Listings
Each property may only be listed once on the Platform. Duplicate or near-duplicate listings by the same or different users are subject to removal.
Listing Duration
Listings remain active based on your subscription plan. Expired listings will be automatically deactivated. You may renew or extend at any time.
Content Moderation
All listings are subject to review and approval by our team. We reserve the right to reject or remove any listing that does not meet our quality standards.
Transaction Terms
City Real Estate Portal acts solely as an intermediary platform. We do not participate in, guarantee, or take responsibility for any property transaction between buyers, sellers, renters, agents, or builders conducted through the Platform.
All property transactions, including negotiations, agreements, payments, and transfers, are conducted directly between the involved parties. Users are responsible for:
- Conducting due diligence before entering into any property transaction.
- Verifying property documents, ownership, and legal status independently.
- Engaging qualified legal professionals for property documentation.
- Complying with local property registration laws and stamp duties.
Fees & Commissions
The following fee structure applies to the use of our Platform:
All fees are listed on our Subscription Plans page. Prices are inclusive of applicable taxes unless stated otherwise.
Refund Policy
Our refund policy for paid subscriptions and services is as follows:
Within 24 Hours
Full refund if no listing has been published under the new plan.
Within 7 Days
Pro-rated refund may be considered on a case-by-case basis.
After 7 Days
No refunds will be issued. You may continue using the plan until expiry.
Refund requests must be submitted via email to our support team. Processing may take 5–10 business days.
Builder Conditions
Users registered as Builders on the Platform agree to additional conditions:
- Provide valid company registration and license details for verification.
- Ensure all project listings include RERA registration numbers (where applicable).
- Keep project timelines and specifications updated on the Platform.
- Respond to buyer enquiries within a reasonable timeframe (48 hours recommended).
- Not list properties that are under legal dispute or have pending litigation.
Agent Conditions
Users registered as Agents on the Platform agree to additional conditions:
- Must have written authorization from property owners before listing.
- Clearly disclose your role as an agent in all communications.
- Not misrepresent properties or use bait-and-switch tactics.
- Maintain professional conduct with all enquiries and clients.
- Handle client information with confidentiality and in accordance with our Privacy Policy.
Owner Conditions
Users registered as Owners on the Platform agree to additional conditions:
- Must be the legal owner or have valid power of attorney for the property.
- Ensure the property has clear title and is free from encumbrances.
- Promptly update or remove listings when a property is sold, rented, or unavailable.
- Provide truthful information about the property's condition, age, and specifications.
- Respond to genuine buyer/renter enquiries in a timely manner.
Content Guidelines
All content uploaded to the Platform must adhere to the following guidelines:
- Upload clear, high-quality property images
- Write accurate, detailed descriptions
- Use real photos of the actual property
- Include correct pricing and location
- Keep listings updated and relevant
- Use stock or misleading images
- Include contact info in listing images
- Post offensive or inappropriate content
- Copy listings from other platforms
- Embed hidden text or spam keywords
Dispute Resolution
In the event of any dispute arising out of or in connection with this Agreement, the parties agree to follow this resolution process:
Informal Resolution
Contact our support team to attempt amicable resolution within 30 days.
Mediation
If unresolved, parties may agree to mediation by a mutually appointed mediator.
Arbitration
Binding arbitration under the Arbitration and Conciliation Act of India.
Legal Proceedings
Courts of India shall have exclusive jurisdiction for unresolved disputes.
Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to:
Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the parties.
